Terms of Service
Effective: December 2025 · These Terms govern your use of Desert Sky Concierge services and the website desertskyconcierge.com. By booking or using our services, you agree to these Terms.
1) Who we are
Desert Sky Concierge LLC (“DSC”, “we”, “us”) provides luxury concierge, mobile notary, remote online notarization, and executive/virtual assistant services in the Greater Phoenix area and, by request, surrounding communities.
2) Not legal advice
We are not attorneys and do not provide legal advice. For notarization, we perform duties permitted under Arizona law. If you need legal guidance, you must consult licensed counsel. You are responsible for obtaining your own legal, tax, or financial advice before relying on any notarized document or decision.
3) Booking, scope & availability
- Requests: Submit via our Contact page, email, or phone.
- Confirmation: Bookings are confirmed only when DSC accepts in writing (email/text) with date, time, location (or platform), and scope.
- Priority scheduling: May be offered for retainers or confirmed projects. Rush/after-hours support is subject to feasibility and may include additional fees.
- Limits: We may decline requests that are outside legal, ethical, licensing, or safety standards, or that conflict with other commitments.
4) Client responsibilities
- Provide accurate information, access, and timely approvals so services can be performed safely and efficiently.
-
For notary services (in person or remote), you must:
- Present acceptable, valid government-issued photo identification.
- Ensure documents are complete (no blank lines or missing pages) before the notarization begins.
- Ensure all signers appear in person (or on the approved remote platform), are willing, and will sign in the presence of the notary.
- For Remote Online Notarization (RON), you must complete identity verification, credential analysis, and any platform-specific requirements truthfully and personally.
- You are responsible for reviewing documents for accuracy and suitability before signing. We do not review content for legal sufficiency or correctness.
4A) Integrity in Every Service
Desert Sky Concierge does not provide real estate brokerage, process serving, or courier delivery of controlled substances. We do not engage in legal, medical, or financial advisory services. Our role is to support you with administrative, notarial, and lifestyle services within the scope of Arizona law — delivered with integrity, precision, and confidentiality.
5) Client conduct & lawful use
We work best with clients who value respect, clear communication, and lawful use of our services.
- You agree not to request, encourage, or pressure DSC to falsify documents, backdate notarizations, bypass identity requirements, or otherwise violate Arizona law or professional standards.
- You agree not to use our services for fraudulent, harassing, discriminatory, or unsafe activities, or for any purpose that could reasonably be considered abusive or unlawful.
- DSC may suspend or terminate services immediately if we believe a request or interaction is unsafe, unlawful, deceptive, or inconsistent with these standards.
6) Fees, travel & payment
- Rates may include time-based fees, fixed project fees, travel or after-hours surcharges, witness fees, printing fees, and platform fees for RON where applicable.
- Quotes/estimates are good-faith and exclude unforeseen changes (for example: additional signers, extended wait time, rescheduling, reprints, or additional locations).
- Payment is due upon completion unless otherwise stated; retainers and certain engagements may require prepayment or a deposit.
- We accept common electronic payment methods; details are provided at booking. You are responsible for any bank, card, or platform fees charged by your provider.
7) Cancellations & rescheduling
- Please notify us as soon as possible if you need to reschedule. Short-notice cancellations or no-shows may incur a fee to cover reserved time and travel.
- If DSC must reschedule due to illness, emergency, or circumstances beyond our control, we will offer the next available time or refund any prepaid amount for work not performed. DSC is not liable for indirect losses arising from rescheduling.
8) Third-party vendors & platforms
At your request, we may coordinate with or use third-party vendors and platforms (for example: remote online notarization providers, couriers, scheduling tools, payment processors, or secure file-transfer services).
- These third parties operate under their own terms and privacy policies. DSC does not control and is not responsible for their acts, omissions, outages, delays, data breaches, security incidents, or errors.
- Unless explicitly stated otherwise in writing, you are responsible for any third-party charges or fees billed by those providers.
- Where legally required, we will cooperate with you in responding to a third-party incident, but DSC does not insure or guarantee third-party systems or outcomes.
9) Confidentiality & privacy
We handle client information with discretion and limit access on a need-to-know basis. Our practices for collecting, storing, and using personal information are described in our Privacy Policy, which is incorporated by reference into these Terms.
10) Site content & intellectual property
All content on the website (including text, branding, graphics, and layouts) is owned or licensed by DSC and protected by intellectual property laws. You may not copy, distribute, modify, or exploit site content without prior written permission, except for personal, non-commercial use of the site.
11) Disclaimers
Services are provided using reasonable skill and care and in accordance with applicable Arizona notary and business regulations. Except as required by law, DSC disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Outcomes may depend on your cooperation, third-party timelines, and circumstances outside our control. No specific result, turnaround time, approval, or third-party performance is guaranteed.
12) Limitation of liability
To the fullest extent permitted by law, DSC’s total liability for all claims arising from or related to the services or the website is limited to the total fees you paid to DSC for the specific service giving rise to the claim.
DSC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
13) Indemnification
You agree to indemnify and hold harmless DSC, its members, employees, and contractors from claims, losses, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the services, or your violation of law, except to the extent caused by our gross negligence or willful misconduct.
14) Governing law & venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to that exclusive jurisdiction and venue.
15) Changes
We may update these Terms from time to time. Material changes will be posted on this page with a new “Effective” date. Continued use of the website or services after changes are posted constitutes your acceptance of the updated Terms.
